Ohioan DJ Orrin Lynn Tolliver Jr has been awarded damages to the tune of $1.2 million for ‘improper sampling’ of his 1983 song ‘I Need A Freak’ which was used in the Black Eyed Peas in their hit ‘My Humps’.

Tolliver’s recording partner James McCant registered the song with BMI and allegedly agreed to pay out 75% of royalties for further use of the track for sampling, but McCant denied this and offered the track up to other artist against Tolliver’s will. The Black Eyed Peas were one of the bands to use it but they have not been implicated in the legal action.
