This is all a bit grim. But not surprising. Which makes things all the more grim.

Christian LaBella, a native of California (pictured below), - has been charged with assaulting and harassing the Liz & Dick actress in the early hours of this morning after they met at a Chelsea hotspot.

The 26-year-old starlet is said to have been involved in an all-out brawl after bringing Christian back to her room on the 15th floor of the W Hotel from 10AK nightclub, according to NBC New York. The duo got into a heated physical altercation after Christian began taking photographs of the actress on his camera phone.

According to TMZ, he had in excess of 50 photos and a video. Not sure what she was doing in the video, but it was enough for her to confront Christian and demand he delete the images. In other words, she grabbed the phone off him.

The situation reportedly got out slightly of hand when the 25-year-old suspect asked her to return his phone and she refused.

Lindsay reported the incident to police at around 4:30am and alleged she was choked from behind and thrown on to the ground. She claims he then climbed on top of her and also left scratches on her hands.

A close friend of the actress who was with her during the incident is said to have managed to help her escape and she then pulled the fire alarm for help. Much to the joy of other guests staying at the hotel.

Police then arrived at the W Hotel and arrested Mr. LaBella, while Lindsay is said to have refused medical attention following the arrest.

Now, LaBella isn't just some randomer, according to the Daily Mail "he's his aunt is comedian Heather McDonald (no idea), and he is employed as a staffer for Illinois GOP congressman John Shimkus. On his Facebook page, he has posted images of himself posing with high-profile figures such as Mitt Romney's running mate Paul Ryan and former presidential candidate Herman Cain. He has also met reality superstar Kim Kardashian and her mother Kris Jenner in another encounter pictured on his Facebook profile." Therefore, it'll come as little surprise that LaBella has since been released without charge.

Lindsay's very busy publicist, Steve Honig, released the following statement regarding the lack of charges: "We think it's both distressing and outrageous. Lindsay was assaulted and there needs to be a consequence for that.'

Meanwhile, LaBella's uncle described Lohan has "shameful... She’s using her celebrity to launch a full-scale witch hunt against him just to be relevant again."

The jury will be out for quite some time.
