As Brendan Dassey readies himself for release following the overturning of his conviction, Steven Avery continues to serve out his sentence for the murder of Teresa Halbach.
Avery's lawyer, Kathleen Zellner, will file her appeal on August 29th and has been regularly updating the press on the status of her case, Avery's condition and the general progress of the investigation.
Although Zellner has said repeatedly that DNA evidence which was used to place Avery at the scene of the crime, there now appears to be specific evidence that points not only to Avery's innocence, but also identifies the real killer of Teresa Halbach.
In a wide-ranging interview with The New York Times, Zellner said that her investigation into the murder, which formed the crux of Netflix's Making A Murderer, has yielded some results on specifically who killed Teresa Halbach.
“There is evidence that already exists in the case that points to a different location and a different suspect... We’ve got a combination of forensic evidence and a tip from somebody that we’ve interviewed multiple times that we think is credible."
Once forensic testing has been completed on the DNA samples used to convict Avery, more evidence is likely to come out to support all this. Zellner's petition seeks to access DNA evidence collected in the original investigation to see if the DNA matches samples that Zellner believes are connected to her suspect and, more pointedly, to see if the DNA points to planted evidence in the original trial.
We'll know more in nine days. Stay tuned.
