Khloe Kardashian is being sued for posting a photo of herself on Instagram. 

The reality TV star is being sued by UK photo agency Xposure Photos for allegedly posting a papparazzi photo of herself on Instagram without permission or credit to the photographer. 

The photo, which Khloe posted on September 14th of last year, was of her and her sister Kourtney heading to dinner in Miami. The photo was taken by photographer Manual Munoz outside a Miami restaurant. The photo is part of a series licensed to The Daily Mail a day prior to the star's post. 

“Defendants’ unauthorized use harms the existing and future market for the original Photograph,” the claim reads. “Kardashian’s Instagram post made the Photograph immediately available to her nearly 67 million followers and others, consumers of entertainment news–and especially news and images of Kardashian herself, as evidenced by their status as followers of Kardashian–who would otherwise be interested in viewing licensed versions of the Photograph in the magazines and newspapers that are plaintiff’s customers.”

Xposure Photos are looking for up to $25,000 in damages as well as any potential profits that Kardashian might derive from the use of the photo.

It's a pretty interesting case. Although Munoz took the photo, would Kardashian as the subject who didn't necessarily give consent for the photo to be taken not have any rights to its usage? It will be interesting to see how the Californian courts rule on this.
